Terms of Service

1. Who We Are

38E ("we", "us", "our") is a dating and connection platform built to help people form meaningful relationships based on shared values. Our services are available at three8e.polsia.app and any associated domains.

2. Age Requirement

You must be 18 years of age or older to use 38E. By creating an account, you confirm that you are at least 18. We take this seriously. Accounts found to belong to minors will be permanently removed without notice.

If you believe someone under 18 is using our platform, please report them immediately via the in-app report feature or contact us at hello@38e.co.

3. Your Account

You are responsible for your account and everything that happens through it. This means:

• Use a real email address you control
• Keep your password secure — don't share it
• Be honest in your profile. No impersonation, no fake photos
• One account per person. Multiple accounts will be removed

4. Acceptable Use

38E is for genuine human connection. The following are prohibited:

• Harassment, bullying, threats, or hate speech of any kind
• Sexual content involving minors — this is illegal and will be reported to authorities
• Spam, solicitation, or commercial promotion without authorization
• Sharing others' private information without consent (doxxing)
• Impersonating another person or organization
• Using the platform to scam, defraud, or manipulate other users
• Automated access (bots, scrapers) without written permission
• Attempting to reverse-engineer, hack, or disrupt our services

We reserve the right to remove any content and terminate any account that violates these rules.

5. Content Guidelines

Your profile, photos, and messages are your responsibility. Content must:

• Accurately represent you (real photos, honest bio)
• Be appropriate for all adult audiences in a dating context
• Not include nudity, graphic violence, or illegal content
• Respect the privacy and dignity of others

By uploading content to 38E, you grant us a non-exclusive, royalty-free license to display that content to other users for the purpose of operating the platform. We don't sell your photos or use them in advertising.

6. Account Suspension and Termination

We may suspend or permanently terminate your account if you:

• Violate any part of these Terms
• Receive multiple credible reports from other users
• Are found to be under 18
• Engage in any fraudulent or illegal activity

You may delete your own account at any time from Settings → Delete My Account. Deletion is permanent and removes all your data.

7. Privacy

Your privacy matters. How we collect and use your data is explained in our Privacy Policy. By using 38E, you agree to our data practices.

8. Disclaimer of Warranties

38E is provided "as is" without warranties of any kind. We don't guarantee that you'll find a match, that the service will be error-free, or that it will be available at all times. Dating involves real humans — we can't control how people behave.

9. Limitation of Liability

To the maximum extent permitted by law, 38E and its operators are not liable for:

• Any interactions, meetings, or relationships that occur through the platform
• Indirect, incidental, or consequential damages
• Loss of data or service interruptions
• Actions taken by other users

Always use good judgment and stay safe when meeting people you've connected with online.

10. Data Retention

We retain your data for as long as your account is active. When you delete your account, we remove your profile, photos, messages, and personal information from our active databases. Some data may remain in backups for up to 30 days before being purged.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the date at the top. Continued use of 38E after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Any disputes shall be resolved in Montréal, Québec.
